USPTO ISSUES INTERIM RULES IMPLEMENTING PATENT TERM ADJUSTMENT PROVISIONS

On Monday the USPTO issued an interim rule to implement changes to the patent term adjustment provisions of the AIA Technical Corrections Act.  The Technical Corrections Act, which took effect on January 14, revised the date from which the 14-month patent term adjustment period and the 3-year patent term adjustment period are measured.  Interim rules 1.702, 1.703, and 1.705 apply to any patent granted on or after January 14 and interim rule 1.704 applies to any application in which a notice of allowance was mailed on or after April 1.  Written comments on these interim rules must be submitted by May 31.  IPO’s U.S. Patent Office Practice Committee will be studying the notice.
