WHITE HOUSE AI POLICY FRAMEWORK SAYS AI TRAINING ON COPYRIGHTED WORKS IS LAWFUL, URGES COURTS TO RESOLVE FAIR USE QUESTION
Last week the Trump Administration released its National Policy Framework for Artificial Intelligence, outlining seven areas of federal AI policy it would like Congress to codify into law, including promoting U.S. AI leadership and establishing a national framework that would preempt state AI laws.
For IP stakeholders, the framework’s section on “Respecting Intellectual Property Rights and Supporting Creators” states the Administration’s position that training AI models on copyrighted material does not violate copyright law and is consistent with fair use, while acknowledging that courts are currently considering the issue. The Administration urges Congress not to legislate on the question currently and instead allow the judiciary to resolve it. The framework encourages Congress to consider more limited actions, including enabling collective licensing frameworks allowing rights holders to negotiate compensation from AI providers without antitrust liability, establishing federal protections against unauthorized AI-generated digital replicas of a person’s voice or likeness (with First Amendment exceptions), and monitoring court decisions to determine whether additional protections for creators are warranted.

On Friday, leaders of IPO’s Standing IP Committees met in Washington, DC. Each committee made a short presentation about its plans for 2026 and opportunities for collaboration between committees. The second half of the meeting was reserved for networking and discussion of possible committee projects, such as IP Chat Channel webinars, Annual Meeting panels, and best practices for monthly meetings. Each of IPO’s 29 committees was represented. Thanks to all our committee leaders for their volunteerism and support of IPO.
