IPO MEETS WITH THE JAPAN INTELLECTUAL PROPERTY ASSOCIATION (JIPA)

The IPO delegation met with the Japan Intellectual Property Association (JIPA) on June 9th. Various topics were discussed, with a focus on AI. Managing Director MAKI NAKAMURA (Alps Alpine Co. Ltd.); Chair of the First International Affairs Committee NOBUYUKI TSUJIMOTO (Daikin Industries, Ltd.); and Chair of the Data Strategy Working Group YUICHI SAHO (SoftBank Group Corp.) led the discussion for JIPA.

Co-Chair of the IPO Asian Practice Committee JIMMY CHENG (Qualcomm Inc.) and Co-Vice Chair of the IPO Asian Practice Committee ROBERT SIMINSKI (Harness IP) led the discussion for IPO.  IPO’s annual IP Innovation Dialogue Meetings in Asia was held in Tokyo from June 8-9. This meeting is organized by IPO’s Asian Practice Committee.

COPYRIGHT OFFICE LAUNCHES TENTH TRIENNIAL SECTION 1201 RULEMAKING

Yesterday the U.S. Copyright Office initiated the tenth triennial rulemaking under Section 1201 of the DMCA to determine whether to recommend temporary three-year exemptions to the statute’s prohibition on circumventing technological measures that control access to copyrighted works. Section 1201 bars circumventing a digital access control even when the intended use of the work would be lawful. These exemptions carve out specific classes of works and uses for which circumvention is permitted. Past exemptions have covered uses such as device repair, jailbreaking, security research and accessibility.

The Office is accepting petitions to renew exemptions granted in the ninth proceeding and petitions for new or expanded exemptions by August 24, 2026. Comments responding to renewal petitions are due on September 28, 2026. A notice of proposed rulemaking, three rounds of public comment, and virtual hearings will follow before the Register of Copyrights issues a recommendation to the Librarian of Congress, who adopts the final rule.
