{"id":41966,"date":"2026-05-07T14:37:04","date_gmt":"2026-05-07T18:37:04","guid":{"rendered":"https:\/\/ipo.org\/?p=41966"},"modified":"2026-05-08T09:56:06","modified_gmt":"2026-05-08T13:56:06","slug":"resolution-on-legislative-amendment-to-anti-cybersquatting-consumer-protection-act","status":"publish","type":"post","link":"https:\/\/ipo.org\/index.php\/resolution-on-legislative-amendment-to-anti-cybersquatting-consumer-protection-act\/","title":{"rendered":"Resolution on Legislative Amendment to Anti-Cybersquatting Consumer Protection Act"},"content":{"rendered":"<p><span data-contrast=\"none\"><strong>RESOLVED<\/strong>, that IPO urges Congress to resolve the dispute among the federal circuit courts of appeals regarding the meaning of the terms \u201cregister\u201d and \u201cregistration\u201d in the\u00a0AntiCybersquatting\u00a0Consumer Protection Act (ACPA) to close the loophole created by the Ninth Circuit allowing bad faith renewal or re-registration of domain names.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\"><strong>RESOLVED<\/strong> further, that IPO specifically urges the passage of federal legislation adding a new subparagraph\u00a0(F) to 15 U.S.C. \u00a7 1125(d)(1) as follows:\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">(F) As used\u00a0in this paragraph, the terms \u201cregisters\u201d and \u201cregistration\u201d include the\u00a0initial\u00a0registration, any renewal, and any other re-registration of the domain name, whether with the same or any other domain name registrar.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\"><strong>RESOLVED<\/strong>, further, that, in the absence of congressional action, IPO favors the judicial interpretation of the word \u201cregister\u201d in 15 U.S.C. \u00a7 1125(d)(1)(A) to encompass the initial registration, any renewal, and any other re-registration of a domain name, whether with the same or any other domain name registrar.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>RESOLVED, that IPO urges Congress to resolve the dispute among  [&#8230;]<\/p>\n","protected":false},"author":13323,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[8],"tags":[],"class_list":["post-41966","post","type-post","status-publish","format-standard","hentry","category-board_resolutions"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
