{"id":25042,"date":"2017-01-29T08:40:52","date_gmt":"2017-01-29T13:40:52","guid":{"rendered":"https:\/\/ipo.org\/?p=25042"},"modified":"2019-04-12T08:41:23","modified_gmt":"2019-04-12T12:41:23","slug":"patent-eligible-subject-matter","status":"publish","type":"post","link":"https:\/\/ipo.org\/index.php\/patent-eligible-subject-matter\/","title":{"rendered":"Patent Eligible Subject Matter"},"content":{"rendered":"<p><i>RESOLVED,<span>\u00a0<\/span><\/i>that IPO supports legislation to amend 35 U.S.C. \u00a7 101 as follows:<\/p>\n<p><b>101(a)<span>\u00a0<\/span><\/b><b>ELIGIBLE SUBJECT MATTER<\/b><\/p>\n<p>Whoever invents or discovers, and claims as an invention, any useful<b><span>\u00a0<\/span><\/b>process, machine, manufacture, composition of matter, or any useful improvement thereto, shall be entitled to a patent for a claimed invention thereof, subject only to the exceptions, conditions, and requirements set forth in this Title.<\/p>\n<p><b>101(b)<span>\u00a0<\/span><\/b><b>SOLE EXCEPTION TO SUBJECT MATTER ELIGIBILITY<\/b><\/p>\n<p>A claimed invention is ineligible under subsection (a) if and only if the claimed invention as a whole, as understood by a person having ordinary skill in the art to which the claimed invention pertains, exists in nature independently of and prior to any human activity, or exists solely in the human mind.<\/p>\n<p><b>101(c) SOLE ELIGIBILITY STANDARD<\/b><\/p>\n<p>The eligibility of a claimed invention under subsections (a) and (b) shall be determined without regard as to the requirements or conditions of sections 102, 103, and 112 of this Title, the manner in which the claimed invention was made or discovered, or the claimed invention\u2019s inventive concept.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>RESOLVED,\u00a0that IPO supports legislation to amend 35 U.S.C. \u00a7 101  [&#8230;]<\/p>\n","protected":false},"author":6119,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[8],"tags":[],"class_list":["post-25042","post","type-post","status-publish","format-standard","hentry","category-board_resolutions"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
