{"id":22950,"date":"2018-02-22T12:16:58","date_gmt":"2018-02-22T17:16:58","guid":{"rendered":"https:\/\/ipo.org\/?p=22950"},"modified":"2018-06-04T12:20:03","modified_gmt":"2018-06-04T16:20:03","slug":"ptab-wi-fi-one-whats-next-appeals","status":"publish","type":"post","link":"https:\/\/ipo.org\/index.php\/ptab-wi-fi-one-whats-next-appeals\/","title":{"rendered":"PTAB After Wi-Fi One: What&#8217;s Next for Appeals?"},"content":{"rendered":"<p>Defining the prerogatives of the USPTO\u2019s Patent Trial and Appeal Board under the America Invents Act is one of the great unfinished tasks in U.S. patent law.<\/p>\n<p>The en banc Federal Circuit made an important contribution to that effort in January, ruling in\u00a0<em>Wi-Fi One LLC v. Broadcom Corp.<\/em> that PTAB time-bar determinations under 35 U.S.C. \u00a7 315(b) are appealable because they do not fall within the scope of the judicial-review prohibition of \u00a7 314(d). This overruled an earlier panel decision in <em>Achates v. Apple<\/em>.<\/p>\n<p>Our panel includes a Lead Administrative Patent Judge on the USPTO\u2019s Patent Trial and Appeal Board who has helped develop devise the rules for proceedings under the AIA, a former PTAB Administrative Judge now in private practice, an IP Counsel with Ford Global Technologies LLC who oversees its PTAB docket, and litigator who practices both at the PTAB and before U.S. district courts.<\/p>\n<p>Our panelists will discuss:<\/p>\n<ul>\n<li>The AIA\u2019s various time bars as adjudicated by the PTAB \u2013 and whether there is a standing inconsistency among PTAB panels.<\/li>\n<li>On which other issues are litigants likely to press for appeals such as the naming of all interested parties, or the reach of estoppel.<\/li>\n<li>Real-party-in-interest and privacy, because in practice many potential appeals involve situations with various parties including joint defense groups, indemnification, and patent aggregators.<\/li>\n<li>How will the PTAB respond to increased demands for discovery?<\/li>\n<\/ul>\n<p>Speakers:<\/p>\n<ul>\n<li>Hon.
