The intellectual property ecosystem is at an inflection point and IPO can play an important role in influencing its future. As a broad-based association representing owners, IPO is uniquely positioned to advocate for an IP system that promotes innovation and the development of new technologies. The dramatic impact of coronavirus\/COVID-19 on the lives of people and businesses around the world brings into focus, more than ever, the importance of an IP system that stimulates the innovative process.<\/p>\n<p class=\"p1\">Last year, IPO demonstrated leadership in important policy areas such as patent subject matter eligibility, increasing diversity in patenting, the impact of artificial intelligence on intellectual property law, and international patent harmonization.\u00a0\u00a0In the first quarter of 2020, IPO has supported the Counterfeit Goods Seizure Act, provided feedback about the development of the recently introduced Trademark Modernization Act, and filed an amicus brief at the U.S. Supreme Court in <i>USPTO v. Booking.com<\/i>. IPO also recommended criteria and qualifications for the Director General of WIPO and Register of Copyrights and testified in a public hearing related to the U.S. Trade Representative\u2019s Special 301 Review, highlighting concerns about insufficient protection of IP rights globally. The extent of the impact of coronavirus and the upcoming election in the U.S. is still unknown. But earlier this month at IPO\u2019s <a href=\"https:\/\/ipo.org\/index.php\/springsummit2020\/\">3rd\u00a0Annual Spring Summit<\/a> in Washington,\u00a0DC,\u00a0Senator\u00a0Chris\u00a0Coons, Ranking Member of the Senate Judiciary Subcommittee\u00a0on Intellectual Property,\u00a0encouraged\u00a0IPO to continue to identify solutions to address problems in the system and\u00a0use this uncertain time to\u00a0educate members of Congress on the role of intellectual property rights in driving innovation and supporting the U.S. economy.<\/p>\n<p class=\"p1\">In the last three years, IPO has demonstrated leadership and commitment to developing a pipeline of diverse next generation leaders for the profession. In 2020, members have exciting new programs to learn from and engage with their peers including a\u00a0<a href=\"http:\/\/www.ipo.org\/mentor\">Corporate Mentoring Program<\/a>\u00a0and a\u00a0<a href=\"https:\/\/ipo.org\/index.php\/find-a-committee\/?division=&amp;CommitteeCode=ELS\">Next Generation\u00a0Leaders\u00a0Committee<\/a>, both designed\u00a0to\u00a0foster\u00a0the career development\u00a0of IP professionals through relationship-building\u00a0in\u00a0the\u00a0IPO\u00a0community.\u00a0Members can\u00a0join the\u00a0<a href=\"https:\/\/ipo.org\/index.php\/find-a-committee\/?division=&amp;CommitteeCode=PTFDIL\">Diversity and Inclusion Committee<\/a>\u00a0and its\u00a0<a href=\"https:\/\/connect.ipo.org\/resource-groups\">four Resource Groups<\/a> (Asian IP Professionals, Black IP Professionals, Hispanic IP Professionals and\u00a0Pride and Allies IP\u00a0Professionals)\u00a0to broaden the discussion and education\u00a0about diversity and inclusion in the IP community.\u00a0 Finally, IPO\u2019s prolific <a href=\"https:\/\/ipo.org\/index.php\/find-a-committee\/?division=&amp;CommitteeCode=WIPL\">Women in IP Committee<\/a> continues to make its <a href=\"http:\/\/www.ipo.org\/diversitytoolkit\">Gender Diversity in Innovation Toolkit<\/a> more accessible to organizations by hosting quarterly calls with members.\u00a0Amidst wide-spread social distancing,\u00a0plans for taking\u00a0the toolkit\u00a0on the road\u00a0during the first half of this year have been postponed.\u00a0 Stay tuned, however, for announcements about virtual\u00a0roundtable\u00a0discussions with\u00a0the USPTO\u00a0on how to expand the innovation ecosphere.<\/p>\n<p class=\"p1\">The IPO Education Foundation\u00a0will\u00a0continue to do its\u00a0part educating\u00a0the public about the role IP plays in innovation\u00a0with the launch of\u00a0season\u00a03\u00a0of\u00a0its\u00a0<a href=\"https:\/\/www.ipoef.org\/podcast\/\"><i>Stroke of Genius<\/i>&#x2122;\u00a0podcast<\/a> later in the spring.\u00a0 Subscribe to enjoy fascinating stories about\u00a0patents, trademarks, copyrights, and trade secrets.\u00a0 Catch up on\u202fseasons one and two to learn about inventors like Lonnie Johnson\u00a0(inventor of the Super Soaker), Temple Grandin (inventor, author, and autism activist), and Dean Kamen (inventor of the Segway) and why they would not have been successful without IP protection.<\/p>\n<p class=\"p1\">The IPO Board of Directors and\u00a0professional\u00a0staff are committed to\u00a0tackling the challenges ahead\u00a0and\u00a0finding ways\u00a0to\u00a0better\u00a0serve you.\u00a0The\u00a0IPO community\u00a0consists of\u00a0thought-leaders from all industries including pharma\u00a0and\u00a0biotech,\u00a0high tech, consumer goods and manufacturing, chemical, defense,\u00a0and others.\u00a0 It\u00a0will continue to be a place where ideas are shared, solutions are identified,\u00a0and friendships are maintained,\u00a0even\u00a0if\u00a0we must connect\u00a0virtually\u00a0during these uncertain times.\u00a0\u00a0Be a part of the\u00a0conversation\u00a0and make your voice heard through membership. Washington, DC. <\/span><\/i><i><span data-contrast=\"auto\">We are delighted to share a transcript of his remarks, which has been lightly edited for clarity.<\/span><\/i><\/p>\n<p><b><span data-contrast=\"auto\">SENATOR COONS:<\/span><\/b><span data-contrast=\"auto\">\u00a0\u00a0<\/span><span data-contrast=\"auto\">I love being in a room with people who know something about science and think innovation matters and think that protecting inventions and innovations matter<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Where did all this enthusiasm come from on my part<\/span><span data-contrast=\"auto\">?\u00a0\u00a0<\/span><span data-contrast=\"auto\">Well, I&#8217;m from a family of inventors and patent holders<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Even my\u00a0<\/span><span data-contrast=\"auto\">step-brother<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0who plays<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">guitar in a rock and roll band has a patent, so it&#8217;s nice that I&#8217;ve got a BA in\u00a0<\/span><span data-contrast=\"auto\">c<\/span><span data-contrast=\"auto\">hemistry<\/span><span data-contrast=\"auto\">.\u00a0 B<\/span><span data-contrast=\"auto\">ut at Thanksgiving dinner in my family, I&#8217;m at the kids&#8217; table because I don&#8217;t\u00a0<\/span><span data-contrast=\"auto\">actually do<\/span><span data-contrast=\"auto\">\u00a0chemistry.\u00a0<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">I&#8217;m not actually inventing things<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">But more broadly<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\"> I recognize that [IP is implicated] in <\/span><span data-contrast=\"auto\">making\u00a0<\/span><span data-contrast=\"auto\">policy around\u00a0<\/span><span data-contrast=\"auto\">[many] <\/span><span data-contrast=\"auto\">issues &#8212; I met with the FCC commissioner this morning, the chairman of the FCC\u00a0<\/span><span data-contrast=\"auto\">C<\/span><span data-contrast=\"auto\">ommission to talk about broadband, 5G, artificial intelligence<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">We had an\u00a0<\/span><span data-contrast=\"auto\">A<\/span><span data-contrast=\"auto\">ppropriations hearing yesterday with the Secretary of Energy about our national laboratory system<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0about how are we staying competitive in terms of innovation<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0and we just had a hearing on\u00a0<\/span><span data-contrast=\"auto\">J<\/span><span data-contrast=\"auto\">udiciary<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I<\/span><span data-contrast=\"auto\">\u2019ve<\/span><span data-contrast=\"auto\">\u00a0got to tell you<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">all\u00a0<\/span><span data-contrast=\"auto\">of<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">these issues come back to do we protect intellectual property in this country<\/span><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559731&quot;:1440,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A<\/span><span data-contrast=\"auto\">s<\/span><span data-contrast=\"auto\">\u00a0in-house counsel of a global invention and manufacturing company<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0I learned from day\u00a0<\/span><span data-contrast=\"auto\">one<\/span><span data-contrast=\"auto\">\u00a0that without the ability to protect and defend our IP across the entire family from patents to trade secrets to\u00a0<\/span><span data-contrast=\"auto\">trademarks<\/span><span data-contrast=\"auto\">\u00a0to copyright, if we couldn&#8217;t defend it, we couldn&#8217;t compete.\u00a0<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">If we couldn&#8217;t compete, we couldn&#8217;t fund invention and innovation<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">If we couldn&#8217;t do that, we couldn&#8217;t bring forward life-saving new devices<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Half of that company today is medi<\/span><span data-contrast=\"auto\">c<\/span><span data-contrast=\"auto\">al devices<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Back then<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0it was much more broadly distributed<\/span><span data-contrast=\"auto\">.\u00a0 B<\/span><span data-contrast=\"auto\">ut I get the virtuous cycle that is absolutely anchored in protecting intellectual property<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I hope you&#8217;re doing everything you can to educate\u00a0<\/span><span data-contrast=\"auto\">policymakers<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559731&quot;:1440,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">I was just communicating with the PTO director<\/span><span data-contrast=\"auto\">.\u00a0 W<\/span><span data-contrast=\"auto\">e were just noting with some positivity and relief the outcome of the election that led to D<\/span><span data-contrast=\"auto\">aren<\/span><span data-contrast=\"auto\">\u00a0Tang being the newly elected director general of the World Intellectual Property Organization<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">It was a\u00a0<\/span><span data-contrast=\"auto\">fairly strong<\/span><span data-contrast=\"auto\">\u00a0vote, 55 to 28<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">And I&#8217;ll just say that<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0for all of us who worry about where are we headed globally, seeing that folks who come from jurisdictions that are committed to<\/span><span data-contrast=\"auto\">\u00a0the<\/span><span data-contrast=\"auto\">\u00a0strong protection of patents in particular but other form<\/span><span data-contrast=\"auto\">s<\/span><span data-contrast=\"auto\">\u00a0of IP, seeing them advance in standard-setting bodies, seeing them advance in UN-related bodies is a critical concern of mine and\u00a0<\/span><span data-contrast=\"auto\">wa<\/span><span data-contrast=\"auto\">s actually the line of questioning I carried forward in\u00a0<\/span><span data-contrast=\"auto\">a<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">J<\/span><span data-contrast=\"auto\">udiciary\u00a0<\/span><span data-contrast=\"auto\">C<\/span><span data-contrast=\"auto\">ommittee [meeting] yesterday.<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559731&quot;:1440,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">So<\/span><span data-contrast=\"auto\">\u00a0let me talk just broadly first about where I t<\/span><span data-contrast=\"auto\">hink<\/span><span data-contrast=\"auto\">\u00a0we are<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I think we have weakened our patent system<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I think even as China is strengthening its IP protection, even as China is moving forward in not just filing more patents but in strengthening some of its domestic IP protection system, we have to do a better job\u00a0<\/span><span data-contrast=\"auto\">of<\/span><span data-contrast=\"auto\">\u00a0strengthening our own IP system<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">S<\/span><span data-contrast=\"auto\">o<\/span><span data-contrast=\"auto\">\u00a0there are serious questions that we have to address<\/span><span data-contrast=\"auto\">, such as\u00a0<\/span><span data-contrast=\"auto\">m<\/span><span data-contrast=\"auto\">uddy patent eligibility for critical next<\/span><span data-contrast=\"auto\">&#8211;<\/span><span data-contrast=\"auto\">gen<\/span><span data-contrast=\"auto\">eration<\/span><span data-contrast=\"auto\">\u00a0technolog<\/span><span data-contrast=\"auto\">ies<\/span><span data-contrast=\"auto\">\u00a0like 5G, quantum computing but most centrally<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0artificial intelligence.\u00a0<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">China is systematically\u00a0<\/span><span data-contrast=\"auto\">asserting its role in standard-setting organizations to stake out a critical position in the race for the deployment of 5<\/span><span data-contrast=\"auto\">G.\u00a0\u00a0<\/span><span data-contrast=\"auto\">We really have challenges<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0and I think if we don&#8217;t step forward on\u00a0<\/span><span data-contrast=\"auto\">this<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">we&#8217;re going to discover that the next generation of technologies that deploy globally are subject to being undermined or weakened by standards that we don&#8217;t agree with.<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559731&quot;:1440,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">If a disruptive innovator cannot rely on the ability to defend their invention through patent litigation, then it&#8217;s\u00a0<\/span><span data-contrast=\"auto\">really not<\/span><span data-contrast=\"auto\">\u00a0worth much at all<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">And\u00a0<\/span><span data-contrast=\"auto\">so<\/span><span data-contrast=\"auto\">\u00a0I&#8217;ve also got, as you know, some profound concerns about how PTAB trials are playing out and\u00a0<\/span><span data-contrast=\"auto\">how\u00a0<\/span><span data-contrast=\"auto\">serial IPR challenges are playing out<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">S<\/span><span data-contrast=\"auto\">o<\/span><span data-contrast=\"auto\">\u00a0you heard in the introduction a reference to a piece of legislation that I&#8217;ve been trying to move forward for some time, the S<\/span><span data-contrast=\"auto\">TRONGER<\/span><span data-contrast=\"auto\">\u00a0Patents Act.\u00a0<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">It is bipartisan<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">It is bicameral<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">There are very few pieces of legislation that fit those two descriptors<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I try to do things that fit those two descriptors.<\/span><span data-contrast=\"auto\">\u00a0\u00a0<\/span><span data-contrast=\"auto\">We had a hearing last fall on\u00a0<\/span><span data-contrast=\"auto\">this\u00a0<\/span><span data-contrast=\"auto\">legislation that would harmonize, for example, the\u00a0<\/span><span data-contrast=\"auto\">pleading standards under PTAB\u00a0<\/span><span data-contrast=\"auto\">and\u00a0<\/span><span data-contrast=\"auto\">district court trial<\/span><span data-contrast=\"auto\">s<\/span><span data-contrast=\"auto\">\u00a0that would restore the ability of inventors to seek injunctive relief, which I think is critical, and that would eliminate some of th<\/span><span data-contrast=\"auto\">ese<\/span><span data-contrast=\"auto\">\u00a0abusive serial attacks on what should be settled intellectual property.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">\u00a0of three hearings with 45 witnesses<\/span><span data-contrast=\"auto\">\u00a0as<\/span><span data-contrast=\"auto\">\u00a0we continue to try and find a pragmatic fix for patent eligibility for Section 101 reform<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">And I just want to both\u00a0<\/span><span data-contrast=\"auto\">thank\u00a0<\/span><span data-contrast=\"auto\">IPO for being engaged and for being constructive, but<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0to everyone in the room<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0I just want\u00a0<\/span><span data-contrast=\"auto\">you\u00a0<\/span><span data-contrast=\"auto\">to hear that it&#8217;s critical for stakeholders to come to the table in a pragmatic frame and be willing to forge a this<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Congress is almost over<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">It is going to end in a couple of weeks at this point<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"auto\">\u00a0and we just had our first Digital Millennium Copyright Act hearing<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">We had, as you heard in the introduction, 12 subcommittee hearings in the last year<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">That makes this the busiest subcommittee of the entire Senate Judiciary Committee<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">We&#8217;ve conducted the<\/span><span data-contrast=\"auto\">\u00a0hearings<\/span><span data-contrast=\"auto\">\u00a0in a collaborative, positive way<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">We may be the only subcommittee of th<\/span><span data-contrast=\"auto\">e<\/span><span data-contrast=\"auto\">\u00a0Senate Judiciary Committee where the chair and ranking\u00a0<\/span><span data-contrast=\"auto\">actually get<\/span><span data-contrast=\"auto\">\u00a0along, where our staff gets along<\/span><span data-contrast=\"auto\">, where<\/span><span data-contrast=\"auto\">\u00a0we&#8217;re able to come up with a common agenda and agree on witnesses easily<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">And data-contrast=\"auto\">are willing<\/span><span data-contrast=\"auto\">\u00a0to come to the table and be pragmatic to help solve<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">these issues\u00a0<\/span><span data-contrast=\"auto\">&#8212;<\/span><span data-contrast=\"auto\">\u00a0w<\/span><span data-contrast=\"auto\">hether<\/span><span data-contrast=\"auto\">\u00a0it&#8217;s Section 101 or it&#8217;s to help guide our work on DMCA.<\/span><span data-contrast=\"auto\">\u00a0to seize goods for design patent infringement<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">And it&#8217;s my genuine hope that we&#8217;re going to move this forward quickly<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Look, endless hearings are great<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Legislation is better<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Laws are terrific, right<\/span><span data-contrast=\"auto\">?\u00a0\u00a0<\/span><span data-contrast=\"auto\">So<\/span><span data-contrast=\"auto\">\u00a0if I&#8217;m going to keep cashing my paycheck, we ought to see data-contrast=\"auto\">actual\u00a0<\/span><span data-contrast=\"auto\">attention<\/span><span data-contrast=\"auto\">?\u00a0\u00a0<\/span><span data-contrast=\"auto\">First, understanding that technology and innovation and investment are differently configured across the folks who invent and make things<\/span><span data-contrast=\"auto\">, right?<\/span><span data-contrast=\"auto\">\u00a0\u00a0<\/span><span data-contrast=\"auto\">S<\/span><span data-contrast=\"auto\">o<\/span><span data-contrast=\"auto\">\u00a0there&#8217;s folks in Silicon Valley and there&#8217;s folks in telecom and comm<\/span><span data-contrast=\"auto\">unications who have one set of views about IP<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0which are not irrational<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">They&#8217;re well rooted in their economic ecosystem and how the cycle of innovation and investment works and is rewarded.<\/span><span data-contrast=\"auto\">But it is exactly opposite if you&#8217;re inventing a new pharmaceutical, you&#8217;re discovering a new pharmaceutical, if you&#8217;re inventing a new material, if you&#8217;re deploying a new composite<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I mean the things that Du<\/span><span data-contrast=\"auto\">P<\/span><span data-contrast=\"auto\">ont did in my community when I was a kid, the stuff they were inventing is very different from release 2.4.7 of the latest\u00a0<\/span><span data-contrast=\"auto\">app.\u00a0\u00a0<\/span><span data-contrast=\"auto\">And you view IP differently in these two worlds.<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0and of our competitiveness that is related to our military and our sustainable competitive advantage globally is at this end of that spectrum<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0not at this end<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">That&#8217;s a big push and would be a big win because most senators, if someone comes and talks fancy at him about inventing stuff, they think it&#8217;s all the same, no disrespect<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">But more senators came to the Judiciary Committee having been prosecutors and attorneys general than any other route<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0and that means they had virtually no exposure to IP at all<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">A<\/span><span data-contrast=\"auto\">nd\u00a0<\/span><span data-contrast=\"auto\">others<\/span><span data-contrast=\"auto\">\u00a0have no legal background or business background.<\/span><span data-contrast=\"auto\">You shouldn&#8217;t assume that senators get and can differentiate between small inventors, big inventors and incumbents and disruptive<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">You shouldn&#8217;t assume they&#8217;ve ever watched Shark Tank<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I went to one of my colleagues and said\u00a0<\/span><span data-contrast=\"auto\">you know,\u00a0<\/span><span data-contrast=\"auto\">\u201cW<\/span><span data-contrast=\"auto\">hen you watch Shark Tank and they get to that investment moment<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0and one of the investors says do you have a patent<\/span><span data-contrast=\"auto\">?<\/span><span data-contrast=\"auto\">\u201d<\/span><span data-contrast=\"auto\">\u00a0\u00a0<\/span><span data-contrast=\"auto\">He&#8217;s like<\/span><span data-contrast=\"auto\">, W<\/span><span data-contrast=\"auto\">hat&#8217;s Shark Tank<\/span><span data-contrast=\"auto\">?<\/span><span data-contrast=\"auto\">\u201d<\/span><span data-contrast=\"auto\">\u00a0\u00a0<\/span><span data-contrast=\"auto\">And I went okay<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I was trying to be relatable here<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Recognizing the gap between the world you live and work in and the world senators live and work in is huge, A.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">\u00a0B, these fights are not based on science<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">They are based on politics<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">s<\/span><span data-contrast=\"auto\">\u00a01,500 people in a world<\/span><span data-contrast=\"auto\">&#8211;<\/span><span data-contrast=\"auto\">class manufacturing facility in my state<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">My state, we&#8217;ve got lots of manufacturing that is directly related to the protection of IP<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">That link is also not clear<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">Like why does a strong<\/span><span data-contrast=\"auto\">er<\/span><span data-contrast=\"auto\">\u00a0IP system lead to more employment<\/span><span data-contrast=\"auto\">?\u00a0\u00a0<\/span><span data-contrast=\"auto\">Like what<\/span><span data-contrast=\"auto\">?\u00a0\u00a0<\/span><span data-contrast=\"auto\">This is not an obvious thing<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I don&#8217;t know\u00a0<\/span><span data-contrast=\"auto\">as much<\/span><span data-contrast=\"auto\">\u00a0about tribal governance, tribal politics and Indian country<\/span><span data-contrast=\"auto\">, given\u00a0<\/span><span data-contrast=\"auto\">my previous experience<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">There are very<\/span><span data-contrast=\"auto\">\u00a0few<\/span><span data-contrast=\"auto\">\u00a0senators who have any previous experience in a business environment where the legal protection of IP is relevant<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I am no expert<\/span><span data-contrast=\"auto\">.<\/span><span diagnostics back<\/span><span data-contrast=\"auto\">?\u00a0\u00a0<\/span><span data-contrast=\"auto\">Because right now diagnostics are dead thanks to Myriad and Prometheus<\/span><span data-contrast=\"auto\">\u00a0and<\/span><span data-contrast=\"auto\">\u00a0for the same reason that you&#8217;re talking about AI and 5G and everything else<\/span><span data-contrast=\"auto\">.\u00a0 B<\/span><span data-contrast=\"auto\">ut arguably there is no economic incentive for us to develop diagnostics\u00a0<\/span><span data-contrast=\"auto\">at this time<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">And there is all the economic incentive to take\u00a0<\/span><span data-contrast=\"auto\">all of<\/span><span data-contrast=\"auto\">\u00a0the genetic data and make a trade secret<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0which is what in many ways Myriad and BRCA1 led growing fields that are directly relevant where investment is moving to other countries, predictability<\/span><span data-contrast=\"auto\">\u00a0&#8212;<\/span><span data-contrast=\"auto\">\u00a0so predictability has moved to other countries<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0so investment is moving to other countries<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0so development is moving to other countries<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0so the opportunities are moving to other countries.<\/span><span data-contrast=\"auto\">\u201d<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">And helping folks see that that&#8217;s what&#8217;s going on would be critical.<\/span><span data-contrast=\"auto\">I mean who doesn&#8217;t want to spend<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">six to eight hours hearing from experts about Section 101 reform<\/span><span data-contrast=\"auto\">?\u00a0\u00a0<\/span><span data-contrast=\"auto\">I mean<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0I want to do that again<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a0\u00a0<\/span><span data-contrast=\"auto\">Everybody in<\/span><span data-contrast=\"auto\">?\u00a0\u00a0<\/span><span data-contrast=\"auto\">Let&#8217;s do it<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">But the frustration that is setting in<\/span><span data-contrast=\"auto\">\u00a0&#8212;<\/span><span data-contrast=\"auto\">\u00a0there is a<\/span><span data-contrast=\"auto\">n<\/span><span drop a rider that suddenly wipes out Supreme Court precedent<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0but it is a teachable moment<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">I am having conversations about vaccines and vaccine development and bio<\/span><span data-contrast=\"auto\">&#8211;<\/span><span data-contrast=\"auto\">defensive measures<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">If you want a world<\/span><span data-contrast=\"auto\">&#8211;<\/span><span data-contrast=\"auto\">class biopharma industry, you got to pay attention to\u00a0<\/span><span data-contrast=\"auto\">whether or not<\/span><span data-contrast=\"auto\">\u00a0a company that invents something or develops something new is actually able to recover their costs<\/span><span data-contrast=\"auto\">.\u00a0\u00a0<\/span><span data-contrast=\"auto\">And whether they can recover their costs\u00a0<\/span><span data-contrast=\"auto\">and<\/span><span Judiciary Subcommittee<\/span><span data-contrast=\"auto\">\u00a0on<\/span><span data-contrast=\"auto\">\u00a0Intellectual Property, led by Chair Thom Tillis (R-N.C.) and Ranking Member Chris Coons (D-Del.),\u00a0<\/span><span data-contrast=\"auto\">was reinstated\u00a0<\/span><span data-contrast=\"auto\">this Congress\u00a0<\/span><span data-contrast=\"auto\">and wasted no time getting to Coons gave a<\/span><span data-contrast=\"auto\">n extremely informative and well-received\u00a0<\/span><span data-contrast=\"auto\">keynote address about<\/span><span data-contrast=\"auto\">\u00a0key issues and<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">his vision for the\u00a0<\/span><span data-contrast=\"auto\">IP\u00a0<\/span><span data-contrast=\"auto\">system<\/span><span data-contrast=\"auto\"> during the IPOwners Spring Summit earlier this month<\/span><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">I\u00a0<\/span><span data-contrast=\"auto\">will review<\/span><span data-contrast=\"auto\">\u00a0highlights of the past fifteen months below, but\u00a0<\/span><span data-contrast=\"auto\">I\u00a0<\/span><span data-contrast=\"auto\">first must<\/span><span data-contrast=\"auto\">\u00a0address\u00a0<\/span><span data-contrast=\"auto\">recent developments related to\u00a0<\/span><span data-contrast=\"auto\">the coronavirus<\/span><span data-contrast=\"auto\">\u00a0pandemic<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"auto\">This\u00a0<\/span><span data-contrast=\"auto\">unprecedented<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">situation<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">has shifted\u00a0<\/span><span data-contrast=\"auto\">everyone\u2019s<\/span><span data-contrast=\"auto\">\u00a0focus<\/span><span data-contrast=\"auto\">,\u00a0<\/span><span data-contrast=\"auto\">including<\/span><span data-contrast=\"auto\">\u00a0lawmakers\u2019,<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">from business as usual to\u00a0<\/span><span data-contrast=\"auto\">crisis management.\u00a0<\/span><span data-contrast=\"auto\">Last week,\u00a0<\/span><span data-contrast=\"auto\">Congress\u00a0<\/span><span data-contrast=\"auto\">passed<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">and President Trump signed\u00a0<\/span><span data-contrast=\"auto\">the\u00a0<\/span><span data-contrast=\"auto\">\u201cCoronavirus Aid, Relief, and Economic Security Act\u201d or the \u201cCARES Act,\u201d a $2 trillion stimulus\u00a0<\/span><span data-contrast=\"auto\">package<\/span><span data-contrast=\"auto\">.\u202f<\/span><span data-contrast=\"auto\">Tucked<\/span><span data-contrast=\"auto\">\u00a0in<\/span><span data-contrast=\"auto\">to<\/span><span data-contrast=\"auto\">\u00a0th<\/span><span data-contrast=\"auto\">is\u00a0<\/span><span data-contrast=\"auto\">massive piece of\u00a0<\/span><span data-contrast=\"auto\">legislation are two provisions\u00a0<\/span><span data-contrast=\"auto\">that affect patent, trademark, and copyright applicants and owners.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Section 12004, titled \u201cTemporary Authority of Director of the USPTO During the\u00a0Covid\u201319 Emergency,\u201d provides the USPTO Director the authority to \u201ctoll, waive, adjust, or modify, any timing deadline established by title 35, United States Code, the Trademark Act, section 18 of the Leahy-Smith America Invents Act \u2026 or regulations promulgated thereunder.\u201d If the Director finds that \u201cthe emergency declared by the President pursuant to the National Emergencies Act on March 13, 2020\u201d in response to the coronavirus pandemic \u201cmaterially affects the functioning of the Patent and Trademark Office,\u201d \u201cprejudices the rights of applicants, registrants, patent owners, or others appearing before the Office,\u201d or prevents users from filing a document or paying a fee timely, the Director will have the authority to determine that \u201ctolling, waiving, adjusting, or modifying a timing deadline\u201d is appropriate and to issue a public notice to that effect. The authority\u00a0<\/span><span data-contrast=\"auto\">took<\/span><span data-contrast=\"auto\">\u00a0effect upon enactment and will end 60 days following the end of the emergency. The U.S. Supreme Court is also closed, which resulted in the postponement of oral arguments in\u00a0the\u00a0<em>Google v. This was\u00a0immediately followed\u00a0by an unprecedented three-day series of hearings\u00a0in June\u00a0\u2014held by the Senate Judiciary IP Subcommittee\u2014on \u201cThe State of Patent Eligibility.\u201d\u00a0A\u00a0diverse group of 45 total witnesses gave testimony about how the law had affected U.S. businesses and commented on the draft legislation.<\/p>\n<p>Despite this extensive activity, several outstanding issues make section 101 reform an unlikely legislative victory this term. Although many witnesses and stakeholders,\u00a0including IPO,\u00a0support\u00a0a legislative solution to the issues the Supreme Court\u2019s section 101 jurisprudence has created for some companies, there are\u00a0others\u00a0who disagree that legislation is necessary and caution against\u00a0unintended consequences\u00a0such as\u00a0a flood of nuisance suits.\u00a0The lawmakers leading the effort\u00a0have indicated that they would like to find language that\u00a0addresses the various concerns.\u00a0In his remarks at the IPO event earlier this month, Sen. The Court remedied the violation by \u201cpartial invalidation of the statutory limitations on the removal of APJs.\u201d On December 16th, the DOJ and the USPTO filed an en banc petition asking the full Federal Circuit to reconsider the <em>Arthrex\u00a0<\/em>decision, claiming that the three-judge panel made \u201cseveral important legal errors.\u201d<\/p>\n<p>The\u00a0House Judiciary IP Subcommittee held a\u00a0<a href=\"https:\/\/judiciary.house.gov\/calendar\/eventsingle.aspx?EventID=2249\" class=\"broken_link\">hearing<\/a>\u00a0to consider the implications of this case and potential legislative solutions\u00a0in November. Chairman\u00a0Jerry\u00a0Nadler (D-N.Y.) and\u00a0IP\u00a0Subcommittee Chairman Johnson expressed\u00a0concerns\u00a0about the proposed remedy, cautioning against removing the civil service designations of APJs.\u00a0They\u00a0stressed that doing so could hinder transparency and force APJs to align with the motives of whoever is the USPTO Director at the time.<\/p>\n<p>Last week, the\u00a0Federal Circuit\u00a0denied rehearing\u00a0en banc\u00a0in\u00a0<em>Arthrex<\/em>, saying it was in line with precedent.\u00a0 Judge Moore filed a concurring opinion, joined by Judges O\u2019Malley, Reyna and Chen, arguing that granting rehearing \u201cwould only create unnecessary uncertainty and disruption.\u201d Moore added that the\u202f<em>Arthrex<\/em>\u202fpanel followed Supreme Court precedent in concluding that APJs were improperly appointed principal officers, and also followed precedent in its solution which severed a portion of the statute \u201cto solve that constitutional problem while preserving the remainder of the statute and minimizing disruption to the inter partes review system Congress created.\u201d\u00a0Judges Dyk, Hughes, and Wallach each filed dissenting opinions\u00a0suggesting that APJs are properly appointed inferior officers. Most court watchers expect\u00a0that a petition for certiorari will be filed in the U.S. Supreme Court.<\/p>\n<p><strong>Trademark Modernization Act of 2020 (<a href=\"https:\/\/www.congress.gov\/116\/bills\/hr6196\/BILLS-116hr6196ih.pdf\">H.R. 6196<\/a>\/<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/senate-bill\/3449\/text?q=%7B%22search%22%3A%5B%22S.+3449%22%5D%7D&amp;r=1&amp;s=3\" class=\"broken_link\">S. 3449<\/a><\/strong>)<\/p>\n<p>On March 12 House Judiciary Committee Chair Nadler and Ranking Member Collins, House IP Subcommittee Chair Johnson and Ranking Member Martha Roby (R-Ala.), and Senate Judiciary IP Subcommittee Chairman Tillis and Ranking Member Coons \u202f<a href=\"https:\/\/ipo.org\/wp-content\/uploads\/2020\/03\/TM-Act-House-Bill-Text.pdf\">introduced the Trademark Modernization Act of 2020<\/a> (TM Act). The bill is intended to provide the USPTO with additional mechanisms to address a significant increase in trademark registrations that falsely claim use of a mark that has not actually been used by the registrant. Many of these applications are filed by applicants outside the U.S. and rely on doctored photos to demonstrate use and fraudulently register a mark.<\/p>\n<p>The TM Act will codify a procedure that allows third parties to submit evidence during the examination of trademark applications and will authorize the USPTO to set response periods for office action actions issued during examination, for time periods ranging from 60 days to six months, with the option to pay additional fees for extensions. It will also create two separate ex\u00a0parte proceedings to allow third parties to request expungement of a registration when a mark has not been used. Finally, the bill will resolve a post-<em>eBay<\/em> circuit split by clarifying that trademark owners are entitled to a presumption of irreparable harm in support of an injunction against a trademark infringer. IPO supports several of these proposals in principle.<\/p>\n<p>The bill was drafted following House and Senate IP Subcommittee hearings in 2019 to consider the surge in bad faith and fraudulent trademark registrations, particularly from mainland China. The USPTO has taken a number of actions such as requiring foreign-domiciled applicants to be represented by U.S. counsel, creating a task force to focus on improper behavior, auditing post-registration maintenance filings, issuing refusals to register marks based on lack of evidence of use in commerce, and allowing third parties to submit evidence in examination. The lawmakers convened a series of stakeholder roundtables to receive feedback on legislative solutions from groups including IPO prior to introducing the TM Act.<\/p>\n<p><b><span data-contrast=\"auto\">Tons of\u00a0<\/span><\/b><b><span data-contrast=\"auto\">Copyright<\/span><\/b><b><span data-contrast=\"auto\">\u00a0Development<\/span><\/b><b><span data-contrast=\"auto\">s\u00a0<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p>The Copyright Alternative in Small-Claims Enforcement Act of 2019 (CASE Act) (<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/2426?q=%7B%22search%22%3A%5B%22H.R.2426%22%5D%7D&amp;s=3&amp;r=1\" class=\"broken_link\">H.R.2426<\/a>\/\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/senate-bill\/1273\" class=\"broken_link\">S.1273<\/a>)\u00a0would establish a voluntary small claims tribunal operating\u00a0within\u00a0the U.S. Copyright Office, called the Copyright Claims Board.<strong>\u00a0<\/strong>The bill passed\u00a0the\u00a0House by a 410-6 vote on October 23rd.<strong>\u00a0<\/strong>It currently has 18 co-sponsors in the Senate and has passed the Senate Judiciary Committee without objection. It is awaiting action on the Senate floor, but Sen. Ron Wyden (D-Ore.) has a hold on the bill in the upper chamber.<\/p>\n<p>Earlier this year Chairman\u00a0Tillis\u00a0<a href=\"https:\/\/thehill.com\/blogs\/congress-blog\/technology\/474918-getting-back-to-basics-on-the-digital-millennium-copyright-act?rnd=1576605068\">announced<\/a>\u00a0his intention to craft new legislation to modernize the\u00a0Digital Millennium Copyright Act (DMCA)\u00a0for today\u2019s internet.<strong>\u00a0<\/strong>He\u00a0will hold\u00a0a series of hearings over the next year to collect feedback,\u00a0with the goal of\u00a0releasing\u00a0a draft\u00a0DMCA\u00a0reform bill\u00a0in\u00a0December 2020. The first DMCA hearing, on\u00a0\u201cThe Digital Millennium Copyright Act at 22: What is it,\u00a0Why\u00a0was it enacted, and Where are we now\u201d\u00a0was held on Feb. 11.\u00a0The\u00a0second was held on\u00a0March 10\u00a0and was titled \u201cCopyright Law in Foreign Jurisdictions:\u00a0How are other countries handling digital piracy?\u201d<\/p>\n<p>Late last year Chairman Tillis (R-NC) circulated a discussion draft of a Copyright Office Modernization bill to stakeholders that participated in a series of roundtable meetings on the issue last fall.<strong>\u00a0<\/strong>The proposed legislation would impact the Copyright Office and the Library of Congress IT infrastructure and modify language for deposit requirements.\u00a0<strong>\u00a0<\/strong><\/p>\n<p>Finally,\u00a0following the departure of former Register of Copyrights\u00a0Karyn Temple in December,\u00a0Maria Strong was\u00a0appointed\u00a0to serve as Acting Register of Copyrights and Director of the\u00a0U.S. Copyright Office. The Supreme Court will have its hands full with several fundamental\u00a0<\/span><span data-contrast=\"auto\">copyright\u00a0<\/span><span data-contrast=\"auto\">questions in\u00a0<\/span><i><span data-contrast=\"auto\">Google v. Oracle<\/span><\/i><span data-contrast=\"auto\">, which focuses on Google\u2019s use of Java source code in Android smartphones.\u00a0\u00a0<\/span><span data-contrast=\"auto\">T<\/span><span data-contrast=\"auto\">he Supreme Court has never directly addressed the copyrightability of software<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">or<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">whether<\/span><span data-contrast=\"auto\">\u00a0Java<\/span><span data-contrast=\"auto\">\u00a0is<\/span><span data-contrast=\"auto\">\u00a0too functional to be copyrightable<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a0\u00a0<\/span><span data-contrast=\"auto\">In addition<\/span><span data-contrast=\"auto\">, it has been many decades since the Supreme Court addressed the fair use defense to copyright infringement.\u00a0 Oral argument was\u00a0<\/span><span data-contrast=\"auto\">originally\u00a0<\/span><span data-contrast=\"auto\">scheduled for March 24 but has been postponed.\u00a0\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Trademarks\u00a0<\/span><span data-contrast=\"auto\">should<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">come in a close second to copyrights in terms of cases to watch.\u00a0 The Supreme Court has\u00a0<\/span><span data-contrast=\"auto\">already\u00a0<\/span><span data-contrast=\"auto\">heard oral arguments in two trademark<\/span><span data-contrast=\"auto\">\u00a0case<\/span><span data-contrast=\"auto\">s<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">and we can expect decisions<\/span><span data-contrast=\"auto\">\u00a0this year.\u00a0 In\u00a0<\/span><i><span data-contrast=\"auto\">Romag v. Fossil<\/span><\/i><span data-contrast=\"auto\">, the justices will address whether willfulness is a requirement for disgorgement of a trademark infringer\u2019s profits under the Lanham Act.\u00a0 IPO filed an\u00a0<\/span><a href=\"https:\/\/ipo.org\/wp-content\/uploads\/2019\/09\/IPO-Brief-Romag_v_Fossil_FILED.pdf\"><span data-contrast=\"none\">amicus brief<\/span><\/a><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">stating<\/span><span data-contrast=\"auto\">\u00a0that willfulness should be a requirement under the statute.\u00a0 And in\u00a0<\/span><i><span data-contrast=\"auto\">Booking.com<\/span><\/i><span data-contrast=\"auto\">, the Supreme Court is wrestling with\u00a0<\/span><span data-contrast=\"auto\">whether the\u00a0<\/span><span data-contrast=\"auto\">addition<\/span><span data-contrast=\"auto\">\u00a0of a top<\/span><span data-contrast=\"auto\">-level<\/span><span data-contrast=\"auto\">\u00a0domain can render an otherwise generic term protectible as a trademark. IPO filed an\u00a0<\/span><a href=\"https:\/\/ipo.org\/wp-content\/uploads\/2020\/02\/IPO-Amicus-Brief_USPTO-v-Booking.com_FILED.pdf\"><span data-contrast=\"none\">amicus brief<\/span><\/a><span data-contrast=\"auto\">\u00a0in this case as well,\u00a0<\/span><span data-contrast=\"auto\">arguing<\/span><span data-contrast=\"auto\">\u00a0that there should not be a per se rule\u00a0<\/span><span data-contrast=\"auto\">against<\/span><span data-contrast=\"auto\">\u00a0such a mark\u00a0<\/span><span data-contrast=\"auto\">achieving\u00a0<\/span><span data-contrast=\"auto\">appropriate<\/span><span data-contrast=\"auto\">\u00a0trademark status.<\/span><span data-contrast=\"auto\">\u00a0 (Full disclosure \u2013 my partners Eric Moran and Nicole Grimm authored both briefs for IPO.<\/span><span data-contrast=\"auto\">)<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Will patent law fall into a deep slumber for the rest of 2020?\u00a0 Not exactly.\u00a0 Constitutional issues continue to loom with respect to IPRs.\u00a0 Most notably, the\u00a0<\/span><span data-contrast=\"auto\">recent\u00a0<\/span><span data-contrast=\"auto\">Federal Circuit<\/span><span data-contrast=\"auto\">\u00a0panel<\/span><span data-contrast=\"auto\">\u00a0decision in\u00a0<\/span><i><span data-contrast=\"auto\">Arthrex<\/span><\/i><span data-contrast=\"auto\">\u00a0held<\/span><span data-contrast=\"auto\">, with its\u00a0<\/span><span data-contrast=\"auto\">left<\/span><span data-contrast=\"auto\">\u00a0hand, that<\/span><span data-contrast=\"auto\">\u00a0the PTAB\u00a0<\/span><span data-contrast=\"auto\">violate<\/span><span data-contrast=\"auto\">d<\/span><span data-contrast=\"auto\">\u00a0the Constitution\u2019s Appointments Clause, while surgically repairing th<\/span><span data-contrast=\"auto\">is<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">violation<\/span><span data-contrast=\"auto\">\u00a0with a statutory scalpel in its\u00a0<\/span><span data-contrast=\"auto\">right<\/span><span data-contrast=\"auto\">\u00a0hand<\/span><span data-contrast=\"auto\">.\u00a0 Subsequent decisions leave no doubt that\u00a0a number of\u00a0Federal Circuit judges disagree with both\u00a0<\/span><span data-contrast=\"auto\">\u201c<\/span><span data-contrast=\"auto\">hands<\/span><span data-contrast=\"auto\">\u201d<\/span><span data-contrast=\"auto\">\u00a0of\u00a0<\/span><i><span data-contrast=\"auto\">Arthrex<\/span><\/i><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">B<\/span><span data-contrast=\"auto\">ut with the recent denial of rehearing en banc, this\u00a0<\/span><span data-contrast=\"auto\">case<\/span><span data-contrast=\"auto\">\u00a0may be headed to the Supreme Court.\u00a0 The Supreme Court has also been asked to grant\u00a0<\/span><i><span data-contrast=\"auto\">certiorari<\/span><\/i><span data-contrast=\"auto\">\u00a0in\u00a0<\/span><i><span data-contrast=\"auto\">Celgene v. Peter<\/span><\/i><span data-contrast=\"auto\">\u00a0to consider whether IPRs can<\/span><span data-contrast=\"auto\">\u00a0constitutionally<\/span><span data-contrast=\"auto\">\u00a0invalidate patents that were issued before the AIA was passed.<\/span><span data-contrast=\"auto\">\u00a0 Stay tuned.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">We do know that the Supreme Court will weigh in on at least one patent case in 2020<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0<\/span><i><span data-contrast=\"auto\">Thryv\u00a0v. Click-to-Call<\/span><\/i><span data-contrast=\"auto\">.\u00a0 In this case<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">which was argued in December,\u00a0<\/span><span data-contrast=\"auto\">the Supreme Court will decide whether \u00a7 314(d) precludes judicial review of\u00a0<\/span><span data-contrast=\"auto\">a<\/span><span data-contrast=\"auto\">\u00a0PTAB\u00a0<\/span><span data-contrast=\"auto\">decision<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">that\u00a0<\/span><span data-contrast=\"auto\">the time bar of<\/span><span data-contrast=\"auto\">\u00a0Section 315(b) does not\u00a0<\/span><span data-contrast=\"auto\">apply in<\/span><span data-contrast=\"auto\">\u00a0grant<\/span><span data-contrast=\"auto\">ing\u00a0<\/span><span data-contrast=\"auto\">inter\u00a0partes\u00a0review<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a0 Another more distant possibility is review of the Federal Circuit\u2019s recent decision in\u00a0<\/span><i><span data-contrast=\"auto\">Facebook v. Windy City<\/span><\/i><span data-contrast=\"auto\">, in which the\u00a0<\/span><span data-contrast=\"auto\">appellate court\u00a0<\/span><span data-contrast=\"auto\">ignored<\/span><span data-contrast=\"auto\">\u00a0<\/span><i><span data-contrast=\"auto\">Chevron<\/span><\/i><span data-contrast=\"auto\">\u00a0deference in adopting a construction of the\u00a0<\/span><span data-contrast=\"auto\">AIA<\/span><span data-contrast=\"auto\">\u00a0directly contrary to the PTAB\u2019s Precedential Opinion Panel (POP).<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">One topic we<\/span><span data-contrast=\"auto\">\u00a0likely<\/span><span data-contrast=\"auto\">\u00a0<\/span><i><span data-contrast=\"auto\">won\u2019t<\/span><\/i><span data-contrast=\"auto\">\u00a0see the Supreme Court\u00a0<\/span><span data-contrast=\"auto\">tackle<\/span><span data-contrast=\"auto\">\u00a0in 2020<\/span><span data-contrast=\"auto\">\u00a0is patent eligibility under Section 101.\u00a0 The justices have been turning\u00a0<\/span><span data-contrast=\"auto\">away\u00a0<\/span><span data-contrast=\"auto\">Section 101\u00a0<\/span><span data-contrast=\"auto\">petitions for cert. by the dozens, including\u00a0a\u00a0<\/span><i><span data-contrast=\"auto\">cri\u00a0de\u00a0couer<\/span><\/i><span data-contrast=\"auto\">\u00a0from\u00a0<\/span><span data-contrast=\"auto\">numerous<\/span><span data-contrast=\"auto\">\u00a0judges on\u00a0<\/span><span data-contrast=\"auto\">the Federal Circuit in\u00a0<\/span><i><span data-contrast=\"auto\">Athena Diagnostics v. Mayo<\/span><\/i><span data-contrast=\"auto\">.\u00a0 Many in the patent field view this benign neglect by the Supreme Court as a good thing; after all, they could always make things worse!<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">And what about Congress?\u00a0 Those of us who attended IPO\u2019s Spring Summit were very impressed with the keynote address delivered by Senator Chris Coons of Delaware.\u00a0 And while he expressed cautious optimism about Congress enacting meaningful IP legislation\u00a0<\/span><span data-contrast=\"auto\">yet\u00a0<\/span><span data-contrast=\"auto\">this year, it is hard to see that happening with the coronavirus taking center, right, and left stage, and during an election year no less.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Which brings us back full circle to the coronavirus.\u00a0 Stay safe, everybody!<\/span><span data-ccp-props=\"{}\">\u00a0<\/span>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_separator color=&#8221;blue&#8221;][vc_column_text]<\/p>\n<h2><a id=\"counterfeit\"><\/a><strong>New Legislation Would Empower U.S. Customs to Seize Products Infringing Design Patents at the U.S. Border<\/strong><\/h2>\n<p><strong>by IPO Industrial Designs Committee Co-Vice Chair Elizabeth D. If enacted into law, the CGSA would allow U.S. Customs and Border Protection (CBP) the discretionary power to enforce recorded U.S. design patents at the U.S. border similar to its current discretionary power for enforcing registered trademarks and copyrights. It can also result in the creation of multi-national platforms, such as Global Dossier, that result in more transparency in the IP system. Further, procedural harmonization should be easier to move forward on a more immediate timeline than significant substantive changes to patent laws.<\/p>\n<p>Enter the Global Assignment project. As described below, having to file patent assignments in a number of countries with different requirements creates unnecessary burdens for IP owners and their attorneys and creates barriers to transparency. As a result, the idea of a global patent assignment was raised by IPO and other members of IP5 Industry during meetings with the heads of the IP5 Offices (the patent offices of China, Europe, Japan, Korea, and the U.S.).<\/p>\n<p>The IPO harmonization team, led by Daniel Staudt (Siemens Corp.), IPO\u2019s President, decided to make the global assignment a priority. IPO instituted a subcommittee which has taken the lead on this issue by gathering information from our members and creating potential global assignment forms. Other IP5 Industry Groups and the IP5 Offices have provided helpful feedback to guide the efforts of IPO\u2019s subcommittee. Chair Shruti Costales (HP Inc.), along with Co-Vice Chair Carlyn Burton (Osha Liang, LLP) and D&amp;I Committee members Rachael Rodman (Ulmer &amp; Berne, LLP) and Scott Barker (Micron Technology, Inc.), participated in a panel introducing the committee\u2019s \u201c<a href=\"https:\/\/ipo.org\/wp-content\/uploads\/2020\/04\/IPO-Practical-Guide-to-DI-3.4.20-DRAFT-FIN1.pdf\">Practical Guide to Diversity and Inclusion in the Legal Profession<\/a>.\u201d The guide, which is set to be officially released at IPO\u2019s 2020 Annual Meeting in San Diego, is meant to advise best practices for creating more diverse and inclusive workplaces in the legal profession.<\/p>\n<p>Taking almost a year to develop, Shruti Costales, Carlyn Burton, Rachael Rodman, Gloria Fuentes (Merck &amp; Co Inc.), Elaine Spector (Harrity &amp; Harrity, LLP), and Serena Farquharson-Torres (Bristol-Myers Squibb Company) banded together to write the document which now includes close to 100 pages of pertinent content.<\/p>\n<p>\u201cWe felt strongly that there was a gap in tools for the legal community\u2014particularly the IP legal community\u2014to address diversity and inclusion in firms and corporate law departments,\u201d said Rodman.<\/p>\n<p>This living document is divided into three segments meant to \u201cmeet every user where they are.\u201d An essential tool filled with data and best practices in relation to diversity for the hiring process and employees\u2019 retention and inclusion, users complete a brief questionnaire to advise on which section offers the best starting point based on responses.<\/p>\n<p>In the committee\u2019s session at the Spring Summit, the panel gave attendees a sneak peak of the practical guide by addressing some of the major points that are noted in the comprehensive document. Attendees were the first to hear the guide\u2019s focus on issues including implicit bias, vague feedback and opportunity gaps. Panelists were able to provide candid examples of how topics in the guide relate to everyday issues in the workplace.<\/p>\n<p>Acknowledging that bias is something we do not often recognize in ourselves, the guide begins by helping identify which portions of the guide will most readily apply to you or your company. The guide is careful to point out and define the difference between diversity and inclusion, which committee members note are two separate things.<\/p>\n<p>\u201cSuccessful diversity and inclusion efforts require both,&#8221; said Rodman. &#8220;Diversity without inclusion results in low retention of and difficulty recruiting diverse employees because diverse candidates do not have a real path to success.\u201d<\/p>\n<p>A true assessment of both diversity and inclusion is necessary as both can greatly affect firm culture and growth. The guide offers definitions and data that support and explain the importance of diversity and inclusion being addressed in legal departments.<\/p>\n<p>Committee members are already enthusiastic about the feedback from #IPOSpringSummit and are currently getting feedback from IPO member companies Micron and Shell. The number of female inventors listed overall was less than 15%.\u00a0 Shortly thereafter, IPO\u2019s Women in IP committee formed the Women Inventors subcommittee, whose goals are to (1) raise awareness to the issue of gender disparity in innovation and (2) create tools to assist IPO member organizations to bring awareness and move toward gender parity in innovation. To accomplish the second goal, the Women Inventors subcommittee created the Gender Diversity in Innovation Toolkit.\u00a0 We worked with more than 25 companies and organizations to identify the root causes of the lack of diversity in innovation, successful methods for determining those root causes, and programs that successfully addressed the root causes.<\/p>\n<div id=\"attachment_29894\" style=\"width: 160px\" class=\"wp-caption alignright\"><img decoding=\"async\" aria-describedby=\"caption-attachment-29894\" class=\"size-thumbnail wp-image-29894\" src=\"https:\/\/ipo.org\/wp-content\/uploads\/2020\/03\/Bugbee-Michelle-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" srcset=\"https:\/\/ipo.org\/wp-content\/uploads\/2020\/03\/Bugbee-Michelle-66x66.jpg 66w, https:\/\/ipo.org\/wp-content\/uploads\/2020\/03\/Bugbee-Michelle-150x150.jpg 150w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/><p id=\"caption-attachment-29894\" class=\"wp-caption-text\">Michelle Bugbee<\/p><\/div>\n<p>No one company or organization can achieve the national and global shift in gender parity on their own, and we are strongest when we are united and coordinated in our efforts.\u00a0 Consequently, the Toolkit will never be a finished work product. Instead, it is meant to be a constantly evolving storehouse of information and best practices available to all IPO members and the general public to contribute to and borrow from so that we can all expedite the trajectory to parity more quickly. We need not all start from scratch and re-create the wheel. All companies and organizations can <a href=\"https:\/\/ipo.org\/index.php\/diversity-in-innovation-toolkit\/\">access the toolkit<\/a> and learn from others about what works best for similar organizations.<\/p>\n<p><strong>What are the top 5 most common barriers to parity that organizations involved in creating the toolkit find?<\/strong><\/p>\n<p>The most common root causes of gender or diverse inventor disparity in innovation (in no specific order) are:<\/p>\n<ul>\n<li>The invention submission process is unclear or not routine.<\/li>\n<li>The invention submission process (or the people running it) is biased or intimidating.<\/li>\n<li>Diverse or female inventors exhibit a confidence gap or perfectionistic tendencies that block them from engaging in the invention submission process either at all or at the right time.<\/li>\n<li>Female or diverse inventors often do not identify as inventors and thus conclude that the process is not \u201cfor them.\u201d<\/li>\n<li>Female or diverse inventors are not working on technical programs with a high likelihood of patent filing.<\/li>\n<\/ul>\n<p><strong>Why is the increase in women in science and engineering occupations not translating into higher rates of women named on patents? <\/strong><strong>\u00a0<\/strong><\/p>\n<p>Although the number of women in engineering and science positions has increased and is getting closer to parity in some cases, the number of women publishing and patenting still lags behind.\u00a0This can likely be attributed to many of the root causes discussed in the Toolkit, such as the fact that women tend to be perfectionists and are not as likely to submit invention reports as early in the process because they are not perfect; cultural norms that cause women to be less likely to \u2018speak up\u2019 and promote their ideas; women not working on the key projects where innovation is taking place or are in jobs less likely to \u2018invent\u2019 (such as analytical roles, supervisors, etc.) which is sometimes due to unconscious and\/or implicit bias within organizations; and women may be unaware of the opportunities to patent or intimidated by the process, which in many cases is male-dominated.<\/p>\n<p><strong>Are there opportunities for IPO to cooperate with other organizations in the public or private sector to improve the rate of change to gender parity and maximize innovation potential? <\/strong><\/p>\n<p>Yes\u2014IPO is cooperating with organizations like the USPTO, WIPO, AUTM, AIPLA, CHIPS and others to increase awareness and highlight the Toolkit to get more companies\/organizations to implement it.\u00a0 The more companies\/organizations that become aware of the Toolkit and start using it, the more we can look to raise awareness of the issue and start to move the needle toward gender parity.\u00a0 Working to improve gender parity (and overall diversity) in innovation is an area where we can all share best practices because by working together, we can expedite the path to parity much faster than if we all work alone or separately in our own organizations.\u00a0 So, not only should organizations and people use the Toolkit, but they should contribute to the evolution of the Toolkit by sharing their ideas, learnings and updates based on their experience using the Toolkit.\u00a0 Click <a href=\"https:\/\/ipo.org\/index.php\/diversity-in-innovation-toolkit\/\">here<\/a> to submit feedback on the toolkit at the bottom of the page.<\/p>\n<p><strong>What do you envision as next steps for the toolkit? \u00a0<\/strong><\/p>\n<p>We intend to continue to update the Toolkit and seek feedback from organizations and companies that are using it. We are developing a Law Firm Toolkit for release in 2020.\u00a0 We are also looking for opportunities to improve overall inclusion and diversity in innovation.<\/p>\n<p>Along those lines, we are excited to announce that later this year IPO will hold a Gender Diversity in Innovation Toolkit Roadshow, hosting discussions about the toolkit and users\u2019 experiences with implementing it in their own companies at different locations across the country including the USPTO\u2019s regional offices. The roadshows will provide audiences opportunity to share valuable feedback. We are still considering whether these will be in-person or virtual based on the coronavirus-related restrictions.<\/p>\n<p>Additionally, the Women in IP Committee will continue to host quarterly calls to discuss tips implementing the toolkit.
